Introduced Text

Idaho S1443 establishes provisions for the conditional release and deportation of illegal alien offenders.

Idaho S1443 amends existing law to allow the director of the department of correction to place illegal alien offenders on conditional release status and release them to immigration and customs enforcement for deportation. This applies to offenders with definite terms, excluding those with life sentences or death sentences. Offenders must be notified and their victims informed before release. If an offender returns illegally, they face a final order of deportation or exclusion and cannot be released again. Offenders remain liable for restitution and other financial obligations.
