Idaho S1397 amends existing law to clarify when wastewater corporations may be considered public utilities.

Idaho S1397 amends the Idaho Code to define "wastewater system" and "wastewater service connection." It also adds "wastewater corporation" to the definition of public utility. The bill exempts wastewater corporations serving fewer than 100 active connections from public utility regulation. It allows the Public Utilities Commission to assess fees to regulated wastewater corporations, not exceeding the costs of oversight. The act declares an emergency and takes effect July 1, 2026.
