Idaho S1304 amends existing law regarding irrigation conduits and rights-of-way. It specifies that the owner or operator of an irrigation conduit must obtain written permission from the servient estate owner before relocating or placing the conduit in a pipe, culvert, or other conduit. The servient estate owner may relocate or pipe the conduit on their own land, provided it does not impede water flow or injure others. The owner or operator of the conduit has the right to remove debris and vegetation necessary for maintenance.
