Idaho H0851 amends existing law to allow punitive damages in cases of libel per se and slander per se.

Idaho H0851 amends Section 6-712 of the Idaho Code to allow plaintiffs to recover punitive damages in cases of libel per se and slander per se, regardless of whether a retraction has been published or broadcast. This change applies to malicious defamation knowingly and deliberately false, or made in reckless disregard of the truth. The bill also includes a technical correction and declares an emergency, making it effective from July 1, 2026.
