Idaho H0809 amends existing law to establish provisions for school of origin hearings for children in foster care.

Idaho H0809 amends the Idaho Child Protective Act to include provisions for school of origin hearings. When a child is removed from their home by the Department of Health and Welfare, the department must determine if it is in the child's best interest to remain in their current school. Parents have the right to choose their child's form of education. The department must provide written notice of its determination to the parents. If the parents object, a hearing is held to determine if the child should remain in their school of origin.
