H0641

Idaho H0641 specifies requirements for the use of earned sick leave, including employer verification and compliance with federal laws.

Idaho H0641 amends Idaho Code to add Section 44-906, detailing requirements for the use of earned sick leave. Employers may require verification of an employee's need for sick leave by a physician or other authorized health care practitioner, but must not request disclosure of diagnoses. Employers must comply with the federal Family and Medical Leave Act and the Americans with Disabilities Act. It is unlawful for employers to count sick leave as an absence that may lead to discipline or adverse employment action.
