This bill amends Hawaii law to exempt parties alleging domestic abuse from mandatory mediation in divorce, custody, and paternity proceedings. If a temporary restraining order or protective order is in effect, the court cannot require the alleged victim to participate in mediation against their wishes. If no such order is in effect, mediation can only proceed if authorized by the alleged victim, provided in a manner that protects their safety, and conducted by a mediator trained in domestic abuse.
