This bill aims to change the law so that government entities in Hawaii are only liable for their share of damages in civil actions related to highway maintenance and design. This change excludes cases involving intentional torts, environmental pollution, toxic and asbestos-related issues, aircraft accidents, strict and products liability, and motor vehicle accidents. The bill also retains joint and several liability for economic and noneconomic damages for claims against design professionals and certified public accountants in cases not involving physical injury or death.
