Hawaii HB810 establishes a private right of action for noise pollution caused by helicopters.

Hawaii HB810 amends Chapter 342F of the Hawaii Revised Statutes by adding a new section that allows any person aggrieved by a violation of the Federal Aviation Act and existing federal laws to bring a civil action against the owner or operator of a helicopter for noise pollution. The aggrieved party can seek to enjoin further violations and recover three times the actual damages or $1,000 per violation, whichever is greater, plus the costs of the suit, including reasonable attorney's fees.
