The bill creates a compassionate release protocol for incarcerated persons in Hawaii who have a terminal illness, debilitating condition, or are too ill or cognitively impaired to participate in rehabilitation. The Hawaii Paroling Authority can grant release to a community setting if the person meets medical criteria and does not pose an unreasonable risk to public safety. The Director of Corrections and Rehabilitation must refer eligible persons to the authority. The authority must hold a hearing within ten business days and grant release if criteria are met. Denials cannot be appealed.
