Hawaii HB1397 amends Chapter 7 of the Hawaii Revised Statutes to affirm that each parent has the right to direct their child's upbringing, education, care, and welfare. The bill prohibits any state department or county from enacting rules, regulations, or ordinances that infringe on these parental rights unless they are narrowly tailored to address a compelling governmental interest using the least restrictive means. The Act does not affect rights, penalties, or proceedings that occurred before its effective date.
