Preempts local regulation of auxiliary containers to the state and requires a departmental report on their regulation.
This bill amends Florida law to preempt local regulation of auxiliary containers, such as bags, cups, and bottles, to the state. It defines "auxiliary container" and restricts the use of glass auxiliary containers within public beaches or state parks. The Division of Recreation and Parks can adopt rules to regulate these containers in state parks. The Department of Environmental Protection must review and update its report on the regulation of auxiliary containers, wrappings, or disposable plastic bags, and submit it to the Legislature by December 31, 2021.
