Criteria for Determining Criminal Gang Membership

Final Passage·3/10/26

Revises the criteria for determining criminal gang membership in Florida.

The bill amends the definition of "criminal gang member" in Florida law. It specifies that a person is considered a criminal gang member if they admit to membership in person or on social media, or if they meet two or more criteria including identification by a reliable informant, adoption of gang-related dress or hand signs, possession of gang-related tattoos, or association with known gang members. The bill also includes new criteria such as participation in recordings promoting gang activity and use of gang-related language on social media. The changes take effect October 1, 2026.
