The Restoring Overtime Pay Act of 2026 amends the Fair Labor Standards Act of 1938 to establish a minimum salary threshold for exempting bona fide executive, administrative, and professional employees from federal overtime pay requirements. The threshold starts at $45,000 and increases annually to $75,000 by 2029. The Secretary of Labor must update the threshold annually based on a data set and methodology capable of being updated. The bill also limits nonexempt duties for exempt employees to not less than 20% of their workweek.
