The Access to Counsel Act of 2025 amends the Immigration and Nationality Act to ensure individuals detained at ports of entry have a meaningful opportunity to consult with counsel and an interested party during inspection. This includes lawful permanent residents, immigrants, nonimmigrants, refugees, returning asylees, and those approved for parole. The Secretary of Homeland Security must provide this opportunity within one hour of secondary inspection and throughout the inspection process.
