Clarifies Clean Air Act standards for emissions from outside the U.S. and exempts certain states from sanctions.
The Foreign Emissions and Nonattainment Clarification for Economic Stability Act, or FENCES Act, amends the Clean Air Act to clarify standards for emissions emanating from outside the United States. It exempts states from sanctions and fees if they demonstrate that emissions from outside the U.S. prevent them from meeting air quality standards. States must renew this demonstration every five years. The Act also prevents areas from being designated as nonattainment areas if they would meet standards but for foreign emissions.
