The NDO Fairness Act of 2026 amends title 18, United States Code, to modify delayed notice requirements for electronic communications. It allows courts to issue orders precluding notice to customers or subscribers if it is likely to endanger lives, cause flight from prosecution, or jeopardize investigations. The court must issue a written determination with findings of fact and conclusions of law. Redactions are permitted to preserve secrecy or integrity. The government must provide a copy of disclosed information to the customer or subscriber upon request.
