Data Care Act of 2025 establishes duties for online service providers regarding end user data.

The Data Care Act of 2025 mandates that online service providers fulfill duties of care, loyalty, and confidentiality with respect to end user data. These duties include securing data from unauthorized access, not using data to benefit the provider at the end user's expense, and not disclosing or selling data to third parties without appropriate contractual obligations. The Act allows state attorneys general and other consumer protection officers to bring civil actions against providers for violations.
