Overview

This resolution seeks to formally censure Representative Al Green of Texas for disrupting the President's State of the Union Address on February 24, 2026. The resolution characterizes the interruption as a breach of proper conduct and decorum during a joint session of Congress. The measure emphasizes that this represents the second instance within a year where Representative Green has been removed from proceedings due to what the resolution terms 'unpatriotic disruptions' violating House rules. The resolution aims to enforce congressional decorum standards and establish consequences for members who disrupt formal legislative proceedings, particularly those involving the President and joint sessions of Congress.

Core Provisions

The resolution establishes a three-part censure mechanism against Representative Al Green. First, it formally declares that Representative Green shall be censured for his conduct during the State of the Union Address. Second, it mandates that Representative Green must forthwith present himself in the well of the House to receive the pronouncement of censure, requiring his physical presence for the disciplinary action. Third, it requires the Speaker of the House to publicly read the entire resolution as part of the censure proceedings. The resolution explicitly references the February 24, 2026 incident and notes this as a pattern of behavior, citing a previous removal within the past year. The censure takes immediate effect upon passage, with no delayed implementation timeline.

Key Points

• Formal censure of Representative Al Green for disrupting the State of the Union Address on February 24, 2026
• Mandatory appearance by Representative Green in the well of the House for censure pronouncement
• Public reading of the complete resolution by the Speaker of the House
• Recognition of pattern of conduct based on second removal within one year

Implementation

The House of Representatives bears primary responsibility for implementing this censure resolution through its leadership and procedural mechanisms. The Speaker of the House holds the specific duty to publicly read the resolution and pronounce the censure once Representative Green presents himself in the well. The resolution was submitted to the Committee on Ethics for referral, indicating that body's role in processing the disciplinary measure. The Sergeant at Arms may be called upon to ensure compliance with the directive for Representative Green to present himself for censure. No funding mechanisms are specified as the resolution involves existing House operations and procedures. The implementation is immediate and self-executing upon passage, requiring no additional regulatory or administrative framework beyond existing House rules governing member discipline.

Impact

The resolution directly impacts Representative Al Green by imposing formal congressional discipline that becomes part of his permanent congressional record. The censure serves as an official rebuke that may affect his standing within the House, committee assignments, and political reputation. The broader House membership is affected through the reinforcement of decorum standards and the demonstration that violations of procedural rules during high-profile events carry consequences. The public and constituents of Texas's district represented by Green are stakeholders in understanding their representative's conduct and the House's response. No direct fiscal costs are associated with the censure itself, though administrative time and resources are required for the formal proceedings. The resolution establishes no sunset provisions, making the censure a permanent mark on Representative Green's congressional record. The expected outcome is both punitive and deterrent, signaling to all members that disruptions of presidential addresses and joint sessions will not be tolerated.

Legal Framework

The constitutional authority for this censure derives from Article I of the United States Constitution, which grants each House of Congress the power to determine the rules of its proceedings and punish its members for disorderly behavior. The censure mechanism represents one of the disciplinary tools available to the House, falling short of expulsion but exceeding a simple reprimand. The resolution invokes House rules related to decorum during proceedings, particularly those governing conduct during joint sessions of Congress when the President addresses both chambers. The State of the Union Address represents a constitutionally mandated communication from the executive to the legislative branch, and disruptions of such proceedings implicate separation of powers principles and the dignity of constitutional processes. The resolution does not create new statutory law or regulatory requirements but rather applies existing House disciplinary procedures to specific conduct. No preemption of state or local law is involved, as this concerns internal congressional discipline. Judicial review of congressional censure resolutions is generally limited, as courts have historically recognized such matters as internal legislative affairs protected by the Speech or Debate Clause and principles of legislative autonomy.

Critical Issues

The resolution presents several areas of potential controversy and constitutional concern. First Amendment considerations arise regarding the extent to which Congress can discipline members for speech acts, even disruptive ones, during legislative proceedings. The characterization of Representative Green's conduct as 'unpatriotic' introduces subjective political judgment into what should be an objective procedural matter, potentially raising questions about whether the censure is based on viewpoint discrimination rather than neutral enforcement of decorum rules. The resolution's reference to a pattern of behavior without providing specific details of the prior incident may raise due process concerns about whether Representative Green received adequate notice and opportunity to respond. Implementation challenges include ensuring Representative Green's compliance with the directive to present himself for censure, as the resolution provides no explicit enforcement mechanism if he refuses. The political context surrounding the censure may generate claims that the action is partisan retaliation rather than legitimate discipline, particularly if the disruption involved criticism of presidential policies. The lack of specificity about what Representative Green actually said or did during the interruption makes it difficult to assess whether the punishment is proportionate to the offense. Opposition arguments likely focus on free speech rights, the political nature of the charges, and concerns about using censure as a tool to silence dissent or minority viewpoints within the legislative body.

Key Points

• First Amendment concerns regarding discipline for speech during legislative proceedings
• Potential viewpoint discrimination through characterization of conduct as 'unpatriotic'
• Due process questions regarding notice and opportunity to respond
• Lack of enforcement mechanism if Representative Green refuses to comply
• Risk of partisan weaponization of censure procedures
• Proportionality concerns given limited details about the actual disruption
• Tension between maintaining decorum and protecting minority dissent
