The Intelligent Arbitration Act of 2026 allows the use of artificial intelligence in arbitration with certain restrictions.
The Intelligent Arbitration Act of 2026 amends federal arbitration law to permit the use of artificial intelligence in arbitration proceedings. Each party must provide written consent for its use. Artificial intelligence can be used for identifying relevant laws, recommending document order, filing supporting documents in undisputed fact cases, and delivering final decisions. However, generative artificial intelligence is prohibited. Parties cannot challenge an arbitration award based solely on an error from the use of artificial intelligence.
