Introduced·7/13/26

Limiting Excessive Government Obstruction Act establishes special rules for certain agency adjudications.

The Limiting Excessive Government Obstruction Act establishes special rules for certain agency adjudications. It allows a party to file a demurrer if an agency adjudication is initiated. If the party files a demurrer, the adjudicator must issue a final order of dismissal with prejudice. Within 90 days of such dismissal, the agency may commence a civil action against the party in the appropriate district court. The act also provides for a jury trial and a reasonable defense in such actions.
