The Fair Telehealth Billing Act of 2026 amends the Employee Retirement Income Security Act of 1974 to prohibit health care providers and facilities from imposing certain facility fees for telehealth services. Specifically, it prevents providers and facilities from billing a separate facility fee when a health care provider authorized to bill independently for telehealth services is involved. The Secretary of Labor will implement these changes through rulemaking, and civil monetary penalties of up to $10,000 per violation may be assessed for non-compliance.
