The STOP Payments Fraud Act of 2026 amends the Expedited Funds Availability Act to provide exceptions for fraudulent checks and wire transfers. It allows depository institutions to not apply certain funds availability requirements if they have reasonable suspicion of fraud. This includes not assessing overdraft fees for fraudulent wire transfers and not applying funds availability requirements for checks if there is reasonable suspicion of fraud.
