Local Control Protection Act prohibits tax credits for data centers without local agreements on tax, infrastructure, and workforce.

The Local Control Protection Act mandates that developers of large data centers must enter into legally enforceable agreements with local governments to be eligible for federal tax credits. These agreements must cover local tax liabilities, infrastructure mitigation, and noise and environmental monitoring. Additionally, a Local Workforce Utilization Plan must be included, demonstrating a preference for local contractors and subcontractors. The Act also prevents federal agencies from approving permits for data centers if the developer is challenging a local zoning denial in court.
