The Transparency in Billing Act of 2026 amends the Employee Retirement Income Security Act of 1974 to require group health plans and health insurance issuers to only pay claims submitted by hospitals that have policies and procedures ensuring accurate billing practices. Hospitals must obtain a separate unique health identifier for off-campus outpatient departments to submit claims. The Secretary of Labor will establish a process for reporting suspected violations and may assess civil monetary penalties for violations.
