Overview

This bill establishes comprehensive procedural requirements that the Department of Homeland Security must satisfy before constructing, acquiring, renovating, or operating any new immigration processing site or detention center. The legislation aims to increase transparency and accountability in DHS facility operations by mandating public participation, intergovernmental coordination, and congressional oversight. The bill responds to concerns about federal immigration enforcement facilities being established without adequate input from affected communities and local governments. By requiring DHS to engage with multiple stakeholders before proceeding with facility-related activities, the legislation seeks to ensure that decisions about immigration detention infrastructure reflect local concerns and receive appropriate scrutiny from elected representatives at all levels of government.

Core Provisions

The bill creates three mandatory procedural requirements that DHS must fulfill before undertaking any construction, acquisition, renovation, or operation of new processing sites or detention centers. First, DHS must establish and provide a mechanism for public comments regarding the proposed activity, ensuring community members have an opportunity to voice concerns and provide input. Second, the agency must enter into a signed, written agreement with appropriate state and local officials, formalizing the relationship and expectations between federal and subnational governments. Third, DHS must provide advance notice to Congress of such activities, enabling legislative oversight and potential intervention. These requirements apply uniformly to all four categories of activity: construction of new facilities, acquisition of existing structures for conversion to immigration purposes, renovation of facilities for immigration use, and operation of new detention or processing sites. The bill does not specify timelines for the public comment period, the content requirements for agreements with state and local officials, or the advance notice period for congressional notification.

Key Points

• Prohibition on DHS construction, acquisition, renovation, or operation of new processing sites or detention centers without compliance
• Mandatory public comment mechanism for all covered activities
• Required signed, written agreements with appropriate state and local officials
• Advance congressional notification requirement
• No specified exceptions, waivers, or emergency provisions

Implementation

The Department of Homeland Security bears sole responsibility for implementing the requirements established by this legislation. The bill does not specify which DHS component or office will manage compliance, though Immigration and Customs Enforcement and Customs and Border Protection would likely be the primary implementing agencies given their operational control over detention and processing facilities. The legislation provides no guidance on the procedural details of implementation, leaving DHS to determine how to structure public comment processes, what constitutes an appropriate agreement with state and local officials, or what information must be included in congressional notifications. No funding is authorized or appropriated for implementation activities. The bill establishes no reporting requirements to track compliance, no compliance monitoring mechanisms, and no enforcement provisions or penalties for violations. This absence of enforcement mechanisms creates uncertainty about how the requirements would be effectuated and what consequences would follow from noncompliance.

Impact

The primary beneficiaries of this legislation are communities where DHS might establish immigration detention or processing facilities, as they gain formal rights to comment on and potentially influence facility decisions. State and local governments receive enhanced authority to negotiate terms and conditions with DHS before facilities are established in their jurisdictions. Congress gains improved oversight capacity through advance notification requirements. The bill would impose administrative burdens on DHS by requiring additional procedural steps before facility operations can commence, potentially delaying facility openings and increasing planning costs. The extent of delay would depend on how long public comment periods last, how quickly agreements with state and local officials can be negotiated, and whether congressional notification triggers legislative action. No cost estimates are provided for either the administrative burden on DHS or the potential impact on immigration enforcement operations. The bill contains no sunset provision, making these requirements permanent unless subsequently amended or repealed.

Legal Framework

The constitutional basis for this legislation rests on Congress's authority under Article I to regulate immigration and naturalize citizens, as well as its power of the purse to impose conditions on executive branch operations. The bill does not explicitly amend any existing statute, instead creating new freestanding requirements that would operate alongside existing DHS authorities. The legislation raises questions about the extent to which Congress can mandate specific procedural requirements for executive branch facility decisions, particularly regarding agreements with state and local officials that might intrude on executive prerogatives. The bill does not address whether it preempts state or local laws regarding facility siting, zoning, or operation, leaving unclear how federal requirements interact with existing state and local regulatory frameworks. No judicial review provisions are included, creating uncertainty about whether affected parties could challenge DHS decisions in court for failure to comply with the statute's requirements or whether compliance would be considered a nonjusticiable political question.

Critical Issues

The bill presents several significant implementation and legal challenges. The absence of definitions for key terms creates substantial ambiguity: what constitutes a "new" processing site versus expansion of an existing facility, who qualifies as "appropriate" state and local officials, and what makes a public comment mechanism adequate all remain undefined. The lack of enforcement mechanisms means DHS could potentially violate the requirements without facing concrete consequences, undermining the bill's effectiveness. The requirement for signed agreements with state and local officials could give subnational governments effective veto power over federal immigration enforcement infrastructure, raising constitutional concerns about whether states can obstruct federal immigration authority. The bill could significantly delay DHS's ability to respond to surges in migration or changing enforcement needs by imposing procedural requirements without time limits or emergency exceptions. Opposition arguments would likely emphasize federal supremacy in immigration matters, operational flexibility concerns, and the potential for local opposition to paralyze federal enforcement capabilities. The bill's silence on what happens if state and local officials refuse to enter agreements creates a critical gap that could render the legislation unworkable in practice.

Key Points

• Undefined key terms: "new" facility, "appropriate" officials, adequate public comment mechanism
• No enforcement mechanisms or penalties for noncompliance
• Potential state/local veto over federal immigration infrastructure
• No emergency exceptions or expedited procedures
• Unclear interaction with existing DHS authorities and state/local regulations
• Risk of indefinite delays if officials refuse to negotiate agreements
