The BE HEARD in the Workplace Act amends several laws to enhance protections against workplace harassment and discrimination. It updates definitions to include sexual orientation, gender identity, and other characteristics. It clarifies employer liability for harassment, including by supervisors and due to negligence. It prohibits nondisclosure clauses in contracts that cover harassment or retaliation. It mandates nondiscrimination training for employers and supervisors. It establishes an Office of Education and Outreach within the Equal Employment Opportunity Commission.
