The ICE and CBP Constitutional Accountability Act provides a civil remedy for individuals whose fundamental rights were violated by U.S. Customs and Border Protection or U.S. Immigration and Customs Enforcement officers. The bill allows for punitive damages in cases of due process violations, racial profiling, unreasonable searches and seizures, and violations of privacy and free speech. The United States Government would be liable for redress regardless of whether a policy or custom of the Department of Homeland Security caused the violation.
