The Pharmacists Fight Back in Medicare and Medicaid Act amends titles XI, XVIII, and XIX of the Social Security Act to establish requirements for pharmacy benefit managers (PBMs) under Medicare and Medicaid. For Medicare, it mandates that contracts with PBMs include pharmacy payment, rebate pass-through, and reporting requirements, and prohibits steering practices. It also imposes criminal and civil penalties for noncompliance. For Medicaid, it requires states to comply with similar requirements when contracting with PBMs.
