The Birth Tourism Elimination Act amends the Immigration and Nationality Act to make inadmissible any alien whose primary purpose for travel is to obtain U.S. citizenship for a child by giving birth in the United States. It prohibits consular officers and U.S. Customs and Border Protection officers from admitting such aliens. The Act also prohibits the use of the Visa Waiver Program for birth tourism and mandates secondary inspections for suspected birth tourists. Additionally, it enhances criminal penalties for facilitating, sponsoring, organizing, or profiting from birth tourism.
