The Essential Caregivers Act of 2026 amends titles XVIII and XIX of the Social Security Act to require nursing facilities, skilled nursing facilities, inpatient rehabilitation facilities, and long-term care hospitals to permit visits from essential caregivers. These facilities must allow residents to elect two essential caregivers for in-person access. Caregivers must follow safety and infection control protocols. Facilities can deny access if caregivers show symptoms of serious infectious diseases or fail to follow safety protocols, but only until the caregiver tests negative or complies.
