As introduced, Bill 26-159 would prohibit health benefit plans and health insurers from using prescription information as a condition of eligibility or to set premium rates. It would prohibit insurers from restricting or imposing delays in the distribution of antiretroviral prescription drugs prescribed to a person for the treatment or prevention of the human immunodeficiency virus (HIV) or acquired immunodeficiency syndrome (AIDS). It would also prohibit health insurers from imposing a deductible, coinsurance, copayment, or other cost-sharing requirement for PrEP or PEP to prevent HIV and AIDS infection.
