Delaware SB41 amends Chapter 33, Title 16 of the Delaware Code to prohibit the sale of food containing Red dye 3. The bill defines "food" as articles for human consumption and makes it illegal to manufacture, sell, or distribute such food within the state. Violations incur civil penalties: $5,000 for a first occurrence and $10,000 for subsequent occurrences, in addition to costs. Each day of violation is considered a separate occurrence. The Act will take effect on October 1, 2027.
