Delaware SB312 prohibits nondisclosure agreements for large-scale data center developments in the state, counties, and municipalities.

Delaware SB312 amends the Delaware Code to prohibit state agencies, counties, and municipalities from entering into nondisclosure agreements that restrict public disclosure of information about potential or actual large-scale data center developments. A large-scale data center is defined as a facility using or capable of using 100 megawatts of power or more. Any such nondisclosure agreements are declared against public policy and void and unenforceable.
