Delaware SB159 amends zoning laws to facilitate the approval of electrical substations for large renewable energy projects.
Delaware SB159 amends Title 26 of the Delaware Code to allow conditional use permits for electrical substations supporting renewable energy projects of 250 MW or greater. Counties cannot deny permits if the substation is in a heavy industrial zone, is an allowed conditional use, and the zone already has a substation with a rating of 230kv or greater as of August 8, 2023. The Act also has retroactive effect, approving any applications made after August 8, 2023, that meet the new criteria.
