Delaware HB89 amends Titles 19 and 29 to establish a mandatory Home Improvement Dispute Resolution Process. This process requires contractors to respond to disputes within 20 days and participate in good faith. Failure to do so is a violation of the Consumer Fraud Act. The Division of Consumer Protection must notify the Department of Labor if a contractor fails to respond or participate in good faith. The bill also allows for treble damages if certain conditions are met. The changes take effect six months after enactment.
