Delaware HB86 amends Title 14 and Title 15 of the Delaware Code to modify the recount procedures for elections. If the number of votes separating the leading candidate and the closest opponent is less than 1,000 votes or ½ of 1% of all votes cast, whichever is less, the Department of Elections must recount the ballots at state expense. For statewide contests, the Department handles the recount as part of the vote canvass. For State Senator, State Representative, or county office elections, the Court conducts the recount.
