Delaware HB61 amends Title 16 of the Delaware Code to prohibit organizations from selling, distributing, or dispensing drugs if they know or should know the drugs will be used in government-sanctioned executions. It also makes officers of organizations civilly and criminally liable for such violations. Violators face class A felony charges and civil penalties up to $50,000. If a corporation violates the law, its charter will be revoked. The bill also requires sellers of drugs containing pentobarbital to have purchasers attest that the drugs will not be used in executions.
