Delaware HB59 amends Title 11 to restrict the release and publication of names and photographs of individuals charged with crimes or delinquency. Specifically, law-enforcement agencies are prohibited from releasing or publishing the name or photograph of an adult unless the individual is suspected of or charged with a felony and the release is necessary to protect public safety. Similarly, the release or publication of the name or photograph of a juvenile is restricted to cases where the juvenile is charged with a violent felony and the release is necessary to protect public safety.
