Final Passage·5/20/26
Draft Text

Amends Delaware law to allow certain individuals to distribute a decedent's property without a grant of letters of administration if the estate's.

Delaware HB333 amends Title 12 of the Delaware Code to allow the named executor in the decedent’s will, the spouse, or next of kin to distribute the decedent's property without a grant of letters of administration if the estate's value is under $50,000. This applies to taking possession of the decedent’s motor vehicle, entering premises to remove clothing, and entering a residential rental unit to remove belongings. The executor has preference over next of kin. If no will or next of kin is available, a funeral director may access the premises to secure clothes.
