Delaware HB315 amends Title 6 of the Delaware Code to modify credit card fee regulations. The bill prohibits payment card networks from establishing, receiving, or charging any interchange fees on the gratuity amount of an electronic payment transaction, provided the merchant transmits the gratuity amount as part of the authorization or settlement process. It also mandates that payment card networks must refund to the merchant the interchange fees charged on the gratuity amount if the merchant submits gratuity data within 180 days of the transaction.
