Draft Text

Delaware HB265 grants immunity from alcohol and drug offenses for individuals reporting sexual offenses or seeking assistance for victims.

Delaware HB265 amends Title 11 of the Delaware Code to provide immunity from alcohol and drug offenses for individuals reporting sexual offenses or seeking assistance for victims. Immunity applies if the person reports the sexual offense in good faith, requests assistance for a victim, or is a victim or witness to the sexual offense. Immunity does not apply if the evidence for the alcohol or drug offense was obtained independently or if the person is alleged to have committed the sexual offense. The bill also ensures that immunity does not affect pretrial release, probation, or parole.
