Delaware HB129 amends Title 10 of the Delaware Code to change how appeals are handled when a court decides to transfer juvenile cases to adult court. Specifically, it allows a child who has been found not amenable to rehabilitation in the Family Court to directly appeal this decision to the Supreme Court within 30 days of sentencing. Similarly, if the Superior Court denies a motion to transfer a case back to the Family Court, the child can appeal this denial to the Supreme Court within 30 days of sentencing.
