California SB916 amends the Code of Civil Procedure to allow defendants in civil actions challenging housing projects to require plaintiffs to post an undertaking as security for costs and damages. This applies to actions challenging housing projects that meet or exceed low- or moderate-income housing requirements or are student housing projects. The liability of the plaintiff for the costs and damages of the defendant is capped at one million dollars. The amount of the undertaking is adjusted annually for inflation.
