For counties with a single public defender, the appointment is made by the respective county's board of supervisors. For counties with a shared public defender, the appointment is made by the boards of supervisors of those counties. The bill also allows for the removal of a public defender by a three-fifths vote of the board of supervisors for neglect of duty, malfeasance, misconduct, or other good cause.
