California SB1416 amends the Business and Professions Code to require physicians and dentists to refund any duplicate payments received from third-party payors to patients within 21 days. If the patient requests a refund, it must be made within 21 days of the request or the receipt of the duplicate payment, whichever is later. If the patient does not request a refund, the physician or dentist must notify the patient of the duplicate payment within 90 days and offer a refund unless the patient prefers to retain a credit balance.
