California AB238, also known as the Mortgage Forbearance Act, allows borrowers experiencing financial hardship due to wildfires to request forbearance on their residential mortgage loans. To qualify, borrowers must submit a request to their mortgage servicer before the earlier of six months after the state of emergency declaration or January 7, 2027, and affirm they are experiencing financial hardship due to the wildfire disaster. Upon request, mortgage servicers must offer forbearance for up to 12 months, in 90-day increments.
