California AB1978, known as the California Equal Shared Parenting Act, introduces a rebuttable presumption favoring equal parenting time in custody cases. This applies to proceedings filed on or after January 1, 2027, if both parents are deemed fit, willing, and able, and reside within 25 miles of the child’s school. Equal parenting time is defined as a substantially equal division of overnights, with each parent receiving no less than 45 percent annually.
