Arizona HB4039 repeals section 25-318.03 of the Arizona Revised Statutes and adds a new section 25-318.03. The new law governs the disposition of in vitro human embryos. If parties have a written agreement on the disposition of the embryos, the court must award the embryos as prescribed in the agreement. If no agreement exists or the agreement is unclear, the court must weigh the interests of the parties and award the embryos based on that determination. The definitions of "human embryo" and "in vitro" are prescribed in section 36-2311.
