Arizona HB2167 amends the state's statutes to establish liability for the attorney general in certain public nuisance actions. If the attorney general files such an action and it is dismissed or found to lack merit, and the attorney general knew or should have known of this lack of basis or publicized the action, they become liable for damages. These damages include reasonable attorney fees, litigation costs, and, for businesses, lost sales, profits, and business value. Additionally, the attorney general must pay a civil penalty three times the amount of the damages.
